BACKGROUND
Berryl is a Senior Associate specialising in litigation in areas of corporate & commercial law, arbitration & dispute resolution.
Over her years in practise, Berryl has ensured that clients receive expert representation in litigation matters and has provided clients with practical and professional advice for seamless completion of corporate transactions.
Berryl holds a Bachelor of Laws (LLB) from the Makerere University and a Post-Graduate Diploma (PGDip) in Law from the Kenya School of Law.
EXPERIENCE
- Part of the Team that represented a company in arbitration for a claim of KES 198,000,000/- from a business partner who occasioned losses to the company.
- Successfully defended a corporate client and counter-claimed in a land dispute where they were sued for breach of contract of the value of KES 118,432,000/- The Vendor had sold land to our client who then paid a deposit but soon thereafter, the title was declared illegal as it was public land but the vendor had nonetheless sued for balance of the purchase price.
- Part of the Team that filed consolidated petitions 56, 58 & 59 of 2019 Nubian Rights Forum & 2 others v Attorney General & 6 others; Child Welfare Society & 9 others (Interested Parties) [2020] eKLR acting for the 1st Petitioner-Nubian Rights Forum challenging the decision of the National Assembly to vote in favour of the enactment into law of the Statute Law (Miscellaneous Amendment) Act No. 18 of 2018, largely known as the “Huduma Namba case”
- Part of the Team that successfully represented a foreign client against an international Organization for unlawful termination on purported ground of redundancy, where the parties agreed on out of court settlement and we negotiated for a compensation of 3,000,000 USD.
- Part of the Team that represented a client to recover sums of money from a bank in Kenya on grounds of breach of fiduciary duty by the bank. The bank approved a transfer of KES 9,000,000 from the client’s private account to a third party without the consent of our client.
