BACKGROUND
Melanie N. Mwenda is an Associate in the Tax and Commercial Dispute Resolution Department and specialises in tax advisory, tax dispute resolution, and general commercial transactions.
Her expertise extends to insolvency, commercial litigation, and data protection and privacy, among other areas.
She holds a Bachelor of Laws (LL.B) from the University of Nairobi and a Post-Graduate Diploma (PGDip) in Law from the Kenya School of Law. Additionally, she is a certified Data Privacy specialist and is currently undertaking her Association of Chartered Certified Accountants Certification.
EXPERIENCE
- Part of the team that successfully worked on a dispute challenging the Commissioner of Domestic Tax’s decision on the interpretation and application of Deemed Interest as enunciated under the Income Tax Act. The High Court dismissed KRA’s KES 18.2 million claim against our client who owns and manages one of the largest shopping malls in East and Central Africa.
- Part of the team advising a multinational transportation company on regulatory compliance regarding its pricing models, specifically and assessing whether the transportation regulator has the authority to dictate trip pricing
- Provided legal advisory services to an international energy and commodities company on the Ownership and Securitization of carbon credits generated within Kenya.
- Part of the team representing a Credit Neo-Bank in a KES 240 million dispute challenging the Commissioner of Domestic Tax’s decision in a dispute where the Kenya Revenue Authority misapplied the provisions of the Income Tax Act and the Kenya-Zambia Double Taxation Agreement.
- Part of the Team that successfully represented a leading architectural firm in the Court of Appeal in a debt recovery and enforcement claim.
- Part of the team representing a microfinance institution in a dispute of KES 91 Million regarding the Commissioner of Domestic Tax’s interpretation and application of Excise Duty on digital lenders.
