Clause 2 Amendment of section 16 of No. 26 of 2012 | Section 16 of the Kenya School of Law Act, 2012 (“the principal Act”) is amended by deleting the words “set out in the Second Schedule for that course” and substituting thereof the words “prescribed by the Council of Legal Education under section 8 (3) (a) of the Legal Education Act, 2012 for that course”. | Currently, the Kenya School of Law (“KSL”) prescribes admission requirements for courses of study that it offers. The courses of study offered by KSL are as follows: a. the Advocates Training Programme (“ATP”); b. the Para-Legal Programme; and c. the Continuing Professional Development Programme. The Bill proposes to confer upon the Council of Legal Education (“CLE”) the power to prescribe admission requirements to courses of study offered by KSL. The KSL Strategic Plan for 2022/2023-2027/2028 (“the Strategic Plan”) indicated that there is a lack of clarity in the admission requirements of the ATP course. Consequently, the Strategic Plan proposed for an amendment of the principal Act to remedy the issue. |
Clause 3 Repeal of the Second Schedule of No. 26 of 2012 | The principal Act is amended by repealing the Second Schedule. | The Second Schedule of the principal Act prescribes admission requirements for courses offered by KSL. We agree with this proposal as the Bill proposes to give CLE the power to prescribe admission requirements for courses offered by KSL. Furthermore, this clause seeks to align the Bill with the proposal stipulated above in clause 2. |
